By accessing and browsing the Site, you accept the Terms of Use without limitation or qualification. You also acknowledge that any other agreements between you and the Site are superseded and have no force or effect:

You agree that the Site itself, along with all content, videos, sound recordings, learning materials, products, services, and other materials made available on the Site by us or third parties, including the overall appearance of these elements (collectively referred to as the "Content"), are intended for your personal use and informational purposes. The Company, Energy Gardener®, owns the property rights to the Content, and you are granted a limited, non-exclusive, non-transferable, and non-sublicensable licence to access, view, and use the Site solely for personal purposes, subject to compliance with these Terms of Use. You may not copy, reproduce, republish, upload, post, transmit, distribute, use the Content for public or commercial purposes, or download it in any way without express written permission from the Company. Modifying the Content or using it for any other purpose violates the copyright and proprietary rights of the Company and the authors of the materials and may result in legal consequences. You may not distribute, modify, transmit, or use the Site's content or any Content, including software, tools, graphics, and sound files, for public or commercial purposes without the express written permission of the Company.

2. Unless otherwise noted, all Content contained in the Site, such as text, data, graphics files, videos, sound files, and other materials, is copyrighted and owned by the Company and/or its suppliers. Such materials may only be used as permitted in these Terms of Use.

All trade names, trademarks, images, and biographical information used in the Company Content and present on the Site, including the names and trademarks "Energy Gardener®, Clear to Grow® and Evolve Your Perspective®" either belong to the Company or are used with permission. Unauthorised use of such Content is strictly prohibited unless expressly permitted by these Terms of Use. Any unauthorised use may violate copyright, trademark, privacy, publicity, and other rights of the Company and third parties, as well as applicable laws and regulations. This Agreement and the Site do not grant any licence or right, implied or otherwise, to use any Trademark or proprietary information without the express written consent of the Company or the third-party owner. The Company respects the intellectual property rights of others and has the right to remove content and accounts that violate intellectual property rights or are considered unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or objectionable, at its sole discretion. 4. While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.

    The Company does not guarantee uninterrupted or error-free use of the materials, nor that defects will be corrected, or that the Site, content, and/or materials available on the Site are free from bugs, viruses, or other harmful components.     The Company shall not be responsible for any performance or service problems caused by any third-party website or service provider. Any such problem shall be governed solely by the agreement between you and that provider. Please note that the exclusion of implied warranties may not be allowed under the applicable jurisdiction. 11. These Terms of Use are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles. By accessing and using the Site, you agree to submit to the exclusive jurisdiction and venue of the courts located in the United Kingdom for any disputes arising from or related to the Site, these Terms of Use, or the Privacy Policy.

You agree to indemnify and hold the Company, its directors, officers, employees, and agents harmless from any and all liabilities, claims, damages, and expenses, including reasonable attorney's fees, arising from (i) your breach of this Agreement, (ii) any violation by you of the law or the rights of any third party, (iii) any materials, information, works, or other content that you post or share on or through the Site, (iv) your use of the Site or any services provided by the Company through the Site, and (v) your conduct in connection with the Site or its services or with other users of the Site or its services. The Company reserves the right to assume exclusive defense of any claim for which we are entitled to indemnification under this section. In such an event, you shall provide the Company with the requested cooperation.

    13. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates, and its third-party content providers and licensors, and each of them shall have the right to assert and enforce these provisions directly or on their own behalf.

    14. This agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and courts in the United Kingdom. If any provision of this agreement is unlawful, void, or unenforceable for any reason, that provision shall be considered separate from this agreement and shall not affect the validity and enforceability of the remaining provisions.
